'Civil Disobedience and Necessity Defence in Climate Cases. On the justifiability of law violations motivated by climate activism under Section 34 of the German Criminal Code (StGB), with particular focus on the concepts of necessity and appropriateness': Can disruptive climate protest action be justified under Section 34 of the German Criminal Code (StGB)? Based on a critical assessment of previous legal interpretations, this thesis explores whether climate activist disobedience can be justified. Scientific findings on climate change and the evaluation of empirical protest research are integral to the analysis. The normative limits resulting from appropriateness are examined in the context of democratic principles and state climate protection deficits.

Jana Wolf studierte an der LMU München Rechtswissenschaften mit dem Schwerpunkt Strafjustiz, Strafverteidigung, Prävention und legte 2021 die Erste Juristische Staatsprüfung ab. Danach arbeitete sie als wissenschaftliche Mitarbeiterin am Lehrstuhl von Prof. Dr. Helmut Satzger in München, wo sie auch promovierte. Ihre Dissertation wurde dabei durch ein Promotionsstipendium der Friedrich-Ebert-Stiftung gefördert. Seit April 2025 befindet sie sich im juristischen Vorbereitungsdienst in München.
